This paper, published by the Center for the Middle East and International Law at Antonin Scalia Law School, is a comparative legal analysis of Israel’s military response to Hamas’s deadly attacks in southern Israel on October 7, 2023. Using the U.S. Department of Defense (DoD) Law of War Manual and examples from American history, this paper aims to shed greater light on the legality of Israel’s actions under the Law of Armed Conflict (“LOAC” or “law of war”).
